In 1998, Mr. Trueblood was one of the first lawyers in California to identify and prosecute class action cases against automotive lenders who were not complying with the post-repossession notice provisions of the Rees-Levering Automobile Sales Finance Act. Landmark Appellate Victory On Credit Reporting.
The case of Sanai v. Saltz, 170 Cal.App. 4th 746 (2009) held that California’s fair credit reporting law is not preempted by the federal Fair Credit Reporting Act. The Trueblood Law Firm drafted the appellate briefs on the preemption issue, and the court adopted our arguments. Before Sanai v. Saltz, the federal courts had ruled for years that consumers had no right whatsoever to sue for inaccurate credit reporting under state law, even though Congress had specifically granted that right. The Sanai decision restored the people’s right to sue for damages when a lender reports inaccurate information to the credit reporting agencies.
Police Impersonation Litigation Against Debt Collectors.
In 2006, there were few consumer attorneys in California suing lenders and debt collectors under the fair debt collection laws, and California was suffering a “Wild West” in debt collection tactics. The Trueblood Law Firm uncovered a shocking scheme, in which a finance company systematically impersonated police and other governmental officials, using a specially designed phone system that spoofed the caller-ID.
